Terms and Conditions of Sale

1. Purpose and scope

These terms govern sales made through eco-rose.com between Rosanna Bueler, sole trader trading as “Ecorose”, hereafter “the Seller”, and any individual acting outside their trade, business or profession, hereafter “the Customer”.

They apply to three types of purchase:

  • downloadable digital guides;
  • zero-waste workshops for individuals;
  • birthday workshops for children.

They do not apply to work carried out for schools, which is a business-to-business relationship governed by a separate agreement whose terms take precedence.

Placing an order implies full acceptance of these terms. The Seller may amend them at any time; the terms applying to an order are those in force on the date the order is placed.

2. Seller identity

Rosanna Bueler, sole trader
5 rue Saint-Louis, 34000 Montpellier, France
SIRET number: 818 660 078 00028
Email: hello@eco-rose.com

3. What is offered

The essential characteristics of each purchase are set out on its own page.

For guides: content, file format, number of pages and language.

For workshops: date, time, duration, location, content, number of places and, where relevant, the age of participants.

Illustrative images are not contractually binding. In the event of an obvious error, the Customer is informed before the order is fulfilled and may cancel free of charge.

4. Prices

Prices are shown in euros. VAT not applicable, article 293 B of the French General Tax Code. No delivery charge applies to digital guides.

The price charged is the one displayed when the order is confirmed. The Seller may change prices at any time, with no effect on orders already placed.

5. Ordering and formation of the contract

Depending on the purchase, orders are placed as follows:

  • digital guides: order form on the site, acceptance of these terms by tick box, then payment;
  • zero-waste workshops: selection of a time slot, acceptance of these terms by tick box, then payment;
  • birthday workshops: booking request form on the site, then payment via a link sent by email.

The contract is formed only once payment has been received. Until then, no place is reserved and no access is granted. Payment links sent by email are valid for 7 days; after that, the slot is released.

A confirmation email summarising the order is sent to the Customer on a durable medium.

The Seller may refuse or cancel any order that appears abnormal, in particular where a previous dispute remains unresolved or fraud is suspected.

6. Payment

Payment is made online, in full, by card through Stripe, whose European entity is Stripe Payments Europe Limited, based in Dublin.

Card details are transmitted directly to Stripe over an encrypted connection. The Seller never has access to them and stores no copy. Payments are subject to strong customer authentication.

7. Delivery of the guides

After payment, the download link is shown on the confirmation page and also sent by email.

The link remains active for 30 days and allows 5 downloads. If you have any difficulty, or if the link has expired, write to hello@eco-rose.com: a new link will be issued free of charge and without condition.

8. Right of withdrawal — digital guides

The Customer has fourteen days from the conclusion of the contract to withdraw, without having to give a reason.

The refund is full and is issued no later than fourteen days after the request is received, using the same payment method as the original order.

The Seller may invite the Customer to say what did not meet their expectations, in order to improve future content. Replying is entirely optional and has no bearing whatsoever on the refund.

Practical details are set out in clause 12.

9. Workshops — no right of withdrawal

Under article L221-28 12° of the French Consumer Code, the right of withdrawal does not apply to leisure services supplied on a specific date or during a specific period.

Ecorose workshops fall within this exception. The cancellation terms that apply instead are set out in clause 10.

10. Cancelling or postponing a workshop

Cancellation by the Customer

  • More than 3 days before the workshop: refund of 50% of the price paid.
  • Less than 3 days before the workshop: no refund.

Transferring your place

The Customer may transfer their place to someone else, at no charge, provided the Seller is notified by email at least 48 hours before the workshop, with the name and contact details of the new attendee.

This applies to workshops for individuals. It does not apply to work carried out for schools, which is governed by its own agreement.

Cancellation or postponement by the Seller

The Seller may cancel or postpone a workshop, in particular where too few people have booked, or in circumstances beyond its control. The Customer is notified by email as soon as possible and chooses between transferring their booking to a later date and a full refund, issued within fourteen days.

The Seller does not reimburse related costs incurred by the Customer, such as travel or childcare.

11. Birthday workshops — specific terms

Location and format

Birthday workshops take place at the Seller’s home, 5 rue Saint-Louis, Montpellier, in the apartment and inner courtyard.

Age and group size

Workshops are open to children aged 3 and over, with a maximum of 6 children per workshop. This limit is firm and cannot be exceeded, including on request.

Supervision and responsibility

The workshop is run by the Seller. The presence of at least one accompanying adult, responsible for the children, is [required / optional] throughout the session.

The parent or legal guardian making the booking confirms they are authorised to register each participating child.

Health and allergies

The parent or legal guardian undertakes to notify in writing, before the date of the workshop, any allergy, food intolerance, medical contraindication or particular need concerning a participating child. In the absence of such information, the Seller cannot be held responsible.

The Seller administers no medication and provides no medical care.

Photographs

No photograph of a child is taken or published without the prior, written and separate consent of the parent or legal guardian. This consent is optional, independent of the booking, and may be withdrawn at any time by writing to hello@eco-rose.com.

12. How to withdraw or cancel

Where the right of withdrawal applies, the Customer may exercise it:

  • online, via the Cancellations and withdrawal page, accessible from the footer of every page of the site;
  • or by any unambiguous statement sent to hello@eco-rose.com or by post to 5 rue Saint-Louis, 34000 Montpellier, France.

The Seller acknowledges receipt without delay on a durable medium. Refunds are issued no later than fourteen days after the Customer’s decision is received, at no cost to the Customer.

13. Statutory guarantees

Digital content supplied by the Seller carries the statutory guarantee of conformity under articles L224-25-12 and following of the French Consumer Code. The Customer may also rely on the guarantee against hidden defects under articles 1641 and following of the French Civil Code.

These guarantees are free of charge. Any claim should be sent to hello@eco-rose.com.

14. Use of the guides

Purchasing a guide grants the Customer a personal, non-exclusive, non-assignable and non-transferable right of use.

Resale, rental, public distribution, uploading to a network or file-sharing platform, and reproduction in whole or in part for commercial or teaching purposes are prohibited without prior written permission from the Seller.

15. Liability

The guides and workshops are informational and educational. They do not constitute personalised advice or a guarantee of any particular outcome. It is for the Customer to judge how the recommendations apply to their own circumstances.

The Seller is not liable for temporary unavailability of the site caused by maintenance, hosting or events beyond its control.

16. Personal data

Data processing carried out in connection with orders and bookings is described in the privacy policy.

17. Complaints, mediation and governing law

Complaints should first be sent to hello@eco-rose.com. The Seller undertakes to respond within 15 days.

If no amicable solution is reached within one month, the Customer may refer the matter free of charge to the consumer mediator named in the legal notice.

These terms are governed by French law. Nothing in them deprives a consumer of the protection afforded by the mandatory rules of the law of their country of residence.

18. Language

These terms are also published in French at /fr/cgv. Where the two versions differ, the French version prevails for customers residing in France.
